Activities Terms

  1. You confirm that the participant is fit and healthy and is able to take part in the activities provided. Should this change you will inform the Club.
  2. You consider the participant capable of following the instructions of all teaching staff and will abide by the participants responsibility policies including wearing appropriate attire.
  3. Parents and Guardians will abide by the Parents and Carers Responsibilities policies, detailed in the participant section of springfit.org/policies
  4. You have provided the Club with all relevant medical details and in the event of illness/injury, you consent for staff to administer suitable treatment, as required.
  5. You understand that as with any sport, there is an element of risk involved and while you accept coaches/staff will take precautions and accidents, you accept that coaches/staff may not be held responsible for loss, damage or injury to the participant or their belongings.
  6. You understand that Springfit Classes have a no-photography policy, anyone taking photographs without expressed permission from the Club will be asked to delete them immediately.
  7. You understand that at Public Events (including but not limited to, fetes, displays and competitions) photographs and videos may be taken.
  8. You understand that Springfit will not accept verbal abuse or violent behaviour, anyone found to be acting in this manner can be asked to leave immediately and may not be permitted to return.
  9. You will make every effort to arrive to class on time to avoid disruption to the order of rotation for trampoline classes and participate in the important warmup and stretch part of gymnastics and parkour classes.
  10. Parents or Guardians will arrive five minutes before the end of classes to collect children promptly. This avoids congestion around class changeover time and ensures the next class can start promptly.
  11. Parents and Guardians should listen to instructions given by the Head coaches and their teams in order to maintain safety in the class settings. Any concerns about safety must be raised with the Springfit Team via email at [email protected].

Medical Exemptions

All participants, members, parents and guardians confirm that they understand that those with the following medical conditions are unfortunately unable to take part in classes at Springfit.

This is due to the nature of the activities offered and the dangers/risks specific to those with the following:

  • Detaching Retina
  • Rodded Backs/Spinal Rods
  • Brittle Bones
  • Pregnancy
  • Downs Syndrome (risk of atlanto-axial instability – AAI)
  • Achondroplasia (and other forms of Dwarfism)

Please read these terms carefully before using the online payment facility. By using the online payment facility on this website you accept these terms. If you do not accept these terms do not use this facility.

The online payments and recurring card payments systems are provided by the Club and its third party suppliers. The Club may need to update these terms from time to time. Any changes will be immediately effective.

Definitions & Interpretations
The terms used in this agreement have the meanings set out below unless the context requires otherwise:

  • “Card supplier” means the institution which owns the debit or credit card you are using on the Online Payment Facility.
  • “Instalment term” means the set period and dates over which fees are calculated and fixed, taking into account planned closures.
  • “Online payment facility” means the secure online payment system operated by Stripe on behalf of Springfit.
  • “Recurring card payment” means payment collections initiated by Springfit to collect amounts due under the instalment term by charging your credit or debit card.
  • “The Club” means Springfit Clubs LLP, trading as Springfit Gymnastics and Trampoline Clubs. Registered address: Swatton Barn, Badbury, Swindon, England, SN4 0EU.
  • “You” means the individual setting up a payment via the online payment facility.

Terms and Conditions.
All payments are subject to the following conditions:

  1. You warrant that in using the online payment facility you are authorised to use the debit or credit card for the payment or payments you are making.
  2. The Club cannot accept liability for a payment not reaching the correct member account due to you providing an incorrect account number or other incorrect details whether personal or otherwise.
  3. The Club cannot accept liability for a payment not reaching the correct member account where payment is refused or declined by the Card Supplier for any reason.
  4. By accepting these terms and conditions, you authorise the Club to charge the debit or credit card account you have provided for instalments within the instalment term described. Instalment terms are fixed for a period of twelve months from September to August across which the subscription fees are equally spread, taking into account scheduled closure dates.
  5. The Club will not be liable for any damages whatsoever arising out of the use, inability to use, or the results of the use of this site, any websites linked to this site, or the materials or information contained at any or all such sites.
  6. The subscription fee is to reserve the place in class for as many weeks as classes run throughout the year and are not payments on a per-session basis, nor dependent upon attendance. This means fees will remain the same whether there are five classes running in any given month or two.
  7. You agree that there will either be sufficient availability under the credit card limit or sufficient funds in the debit card account to make the recurring card payments when they fall due under the instalment terms.
  8. If a recurring card payment collection fails, a second attempt will be made to collect the fees due, and customers will be contacted. If the payment remains overdue for a period of four weeks, the enrolment becomes void, the membership place may be released and any outstanding amount will fall due for immediate payment.
  9. We require a minimum of 24 hours’ notice to process bookings to ensure accurate registers are provided to coaches.
  10. Subscriptions are subject to automatic renewal, as managed by the Club. You may opt out of the auto-renewal at any point by using the cancellation form provided at www.springfit.org/cancellations at least 7 days before the next instalment due date. The Club will process cancellations and terminate subscriptions. Should a balance still be outstanding, the fee will become due for payment in full immediately.
  11. Upon the Club’s cancellation of a place, the place will be held for the remaining prepaid sessions up to when the next instalment was due, and Annual Membership benefits will be revoked.
  12. Payments taken in error by the Club will be fully refunded, and any subsequent bank charges applied by the bank will also be refunded, provided documentary evidence is supplied by the payer.
  13. Any refunds requested by the payer as a result of revoking a confirmed booking, not supplying the required notice period, failing to complete the proper cancellation procedure or making duplicate or additional payments in error are at the discretion of the Club and will be subject to an additional £4.00 charge as passed on by the payment facility.
  14. We reserve the right to amend or withdraw any payment at any point for any reason, but will always notify you in writing if this is necessary.
  15. All payment details which are entered through this payment gateway are encrypted when the Club sets up the facility. Communications to and from the service provider’s site are encrypted.
  16. The Club shall not be liable for any failure by the payer making payment of fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such persons, during the online payment process, or in respect of any omission to provide accurate information in the course of the online payment process.
  17. Online payments of fees can be made by credit or debit card. These payments are not collected by the Club directly but by the online service provider.
  18. When a member makes an online payment they will receive a confirmation email. If this is not received within 14 days it is the responsibility of the member to check with the Club that the payment has been accepted.
  19. The Club will collect (or may already hold) personal data relating to the member, or payer making payment, including name, date of birth, address and member identification number of the member in accordance with the General Data Protection Regulation policy. By agreeing to be bound by these terms and conditions the member, (and any payer making payment), accepts and consents to his/her personal data, as detailed in our privacy policy, being provided to the service provider for the sole purpose of the service provider offering and administering the online payment facility to the member, or payer making payment.
  20. It is the responsibility of the member, or payer making payment, to ensure that all personal data provided to or held by the club and/or provided to the service provider is clear and accurate.
  21. The Club will not be responsible for any losses suffered by the member, or payer making payment, as a result of inaccurate information being provided to the club or the service provider.
  22. The Club may use the personal information provided to it to contact the member, or payer making payment, to clarify or resolve any issues that arise in connection with any online payment made in respect of the fees.
  23. Payment receipts and failed payment notices will be sent to the payer by email.
What is collected?

We record contact details for members and/or parents/guardians, including name, address, contact telephone numbers and email addresses. We also note the gender and date of birth of members and any medical information coaches may need to be aware of. We do not collect any of your payment information. This aspect is handled by our payment supplier (Stripe), who specialise in the secure online capture and processing of credit/debit card transactions. Your email address is shared with Stripe in order to confirm payment details. We may collect information anonymously about users’ interaction with our website through Google Analytics.

Springfit Cubs LLP. (Springfit Head Office) and/or SFRH10 LLP. (Copthorne Franchise) are the organisations controlling data collection and processing for members who have signed up to activities at our Clubs.

We ask for some basic contact information at the point of booking a trial class at one of our Clubs so we can inform the coaches of who will be attending the session and contact you afterwards to find out if you would like to enrol. Upon enrolment, we request more information to create a member record and allow communication with our members about important administrative aspects and useful information about classes.

We are legally obligated to keep accurate records of attendance for Safeguarding and Fire Procedures. We must also ensure all members are able to safely participate based on their existing medical conditions.

The details collected for member profiles also allow us to process, record, and track what classes have been paid for through our booking software (Kinetic+).

Our Course Management software (Kinetic+) uses date of birth and postcode information to verify your Member Hub account, where you can view the member’s progress. We also send out emails from within this system using date of birth and gender details to ensure the information is relevant and suitable. We also send out quarterly newsletters from Brevo to keep you informed with Club news.

We may use your personal information to:

  • Book you into a class or classes you have requested
  • Keep you informed about important Club news and information
  • Provide you with information about offers and class discounts
  • Process orders that you have submitted
  • To carry out obligations arising from any contracts entered into by you and us

Springfit never share your personal information with any third parties other than internal systems used to administer your account and manage the classes you sign up to. These include Kinetic+ for the administration of your class membership, Brevo for Club information mailings and Stripe for information about your payments.

 

You will only receive emails from Springfit via Brevo for informative news, Kinetic+ for class information and bookings, plus Stripe for information about payments.

Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:

  • The right to request a copy of your personal data which Springfit holds about you;
  • The right to request that Springfit corrects any personal data if it is found to be inaccurate or out of date;
  • The right to request your personal data is erased where it is no longer necessary for Springfit to retain such data;
  • The right to withdraw or restrict your consent to the processing at any time;
  • The right to request that the data controller provide the data subject with his/her personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability).
  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;
  • The right to object to the processing of personal data;
    The right to lodge a complaint with the Information Commissioners Office.

What are cookies?
